Copyright and Trademarks  
Copyright law protects original works and gives the creator certain rights and controls over how others can use the work. A copyright owner can prevent the work from being copied, distributed, publicly used or derivative works being made from it. The owner can also sell or give these rights away. Using someone else’s copyrighted work without permission is copyright infringement.

A trademark is a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others.

A service mark is the same as a trademark, except that it identifies and distinguishes the source of a service rather than a product.

 Copyright Notices
Copyright notices are NOT REQUIRED for works to be protected by copyright. Similarly, easy or abundant availability of the work does not mean that it is not copyrighted. Neither does it mean the work is in public domain.

A typical copyright notice has a copyright symbol followed by an effective date and an identifier that names the owner of the copyright. It is common to have a notice reserving rights following the copyright statement.

 Public Domain
If a copyright has expired (because of the limited time allowed on a copyright) or because the owner chooses to allow it, the work can belong in the “public domain”. Public domain works can be used freely without permission.

 Fair Use
In the US, fair use permits the use of copyrighted material in a very limited way. Typically, this applies to a specific situation use such as nonprofit research, news reporting or private study.

Using something incorrectly assuming a work is fair use or public domain could still result in criminal and civil liabilities with penalties if it results in a copyright infringement.
